Please read these Terms of Service carefully before using Pigeon. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and the operator of Pigeon ("Pigeon", "we", "us", "our"), governing your access to and use of the Pigeon web application and all related services (collectively, the "Service").

By registering for an account, accessing, or using the Service in any way, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of an organisation, you warrant that you have authority to bind that organisation to these Terms.

2. Description of Service

Pigeon is a web-based training session companion designed for trainers and facilitators. The Service provides the following functionality:

3. Accounts and Registration

3.1 Account Creation

To access the Service, you must create an account by providing a valid email address and password. You agree to provide accurate, complete, and current information and to keep your account details up to date.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access or suspected breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 One Account Per User

Each account is for use by a single individual. You may not share your account credentials with any other person.

3.4 API Keys

Certain features of the Service require you to provide your own Google Gemini API key. You are solely responsible for obtaining, managing, and securing your API key, and for any costs or usage incurred through it. We store your API key securely in our database but accept no liability for any misuse, expiry, or charges associated with your key.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

5. Your Content

5.1 Ownership

You retain full ownership of all training materials, guides, session data, and other content you create, upload, or generate through the Service ("Your Content"). We claim no intellectual property rights over Your Content.

5.2 Licence to Us

By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit Your Content solely to the extent necessary to provide the Service to you. This licence terminates when you delete the content or close your account.

5.3 Your Responsibility

You are solely responsible for Your Content and the consequences of uploading or sharing it. You warrant that Your Content does not infringe any third-party intellectual property rights and that you have all rights necessary to upload and use it within the Service.

5.4 AI-Processed Content

When you use the AI guide building features, Your Content is transmitted to Google's Gemini API for processing. By using this feature, you acknowledge and accept Google's applicable terms of service and privacy policies, and you warrant that you have the right to submit such content for AI processing.

6. Third-Party Services and AI Features

6.2 AI Output Disclaimer

AI-generated guides are produced automatically and may contain errors, inaccuracies, or omissions. You are solely responsible for reviewing, editing, and verifying all AI-generated content before use. We make no warranty as to the accuracy, completeness, or fitness for purpose of any AI-generated output.

6.3 Speech Recognition

Live session tracking uses your browser's built-in Web Speech API. The accuracy of speech recognition varies by browser, device, and environment. We provide no guarantee as to recognition accuracy and accept no liability for missed or incorrect transcriptions.

6.4 Service Availability

We do not guarantee uninterrupted access to the Service or any third-party service it relies upon. Downtime may occur due to maintenance, technical issues, or factors outside our control.

7. Intellectual Property

The Service, including its design, code, user interface, branding, and documentation, is owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, logos, or other brand features without our prior written consent.

You may not copy, reproduce, modify, or create derivative works of any part of the Service without our express written permission.

8. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

9. Disclaimers and Limitation of Liability

9.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE FROM HARMFUL COMPONENTS.

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you in connection with the Service shall not exceed the greater of (a) the total amount you have paid us in the twelve months preceding the claim, or (b) £100 (one hundred pounds sterling).

9.3 Data Loss

While we take reasonable steps to maintain data integrity, we do not guarantee that Your Content will never be lost, corrupted, or deleted. You are responsible for maintaining your own backups of any critical content.

You agree to indemnify, defend, and hold harmless us and our officers, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

11.1 Termination by You

You may stop using the Service at any time. Account deletion can be requested by contacting us at hello@pigeon.app. Upon deletion, your account and associated data will be removed in accordance with our Privacy Policy.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if we decide to discontinue the Service.

11.3 Effect of Termination

Upon termination, all licences granted to you under these Terms will immediately cease. Provisions which by their nature should survive termination — including Sections 5, 7, 9, 10, and 13 — shall survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. For material changes, we will make reasonable efforts to notify you (for example, by email or by a notice within the Service). Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute arising under or in connection with these Terms.
